This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to expedite the proceedings of Special Case No. 372 of 2024 (State of U.P. Vs. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant is the accused of the case. Charges have been framed in the matter but no evidence has been recorded by the trial court so far. Only dates are being fixed whereas the accused applicant is appearing before the court regularly. The case in hand relates to POCSO Act and a time bound for disposal of such cases has been made in the act itself. The applicant has moved an application for recording the evidence of the victim but no proper order has been passed by the trial court in this matter. 4. I have considered the submissions and perused the entire record. 5. In the circumstances, the learned trial court is directed to record the evidence of the victim of this case within two months from today and then it shall make all possible endeavours to decide this case expeditiously preferably within a period of one year from the date of production of certified copy of this order before it, if there is no legal impediment. 6. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 7.
