Dhurwa, District Ranchi. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Anurag Kashyap, Advocate Mr. Bhashwat Prakash, Advocate Ms. Supriya Dayal, Advocate For the Respondent(s): Mr. Munna Lal Yadav, SC (L & C)-III Mr. Deepak, AC to SC (L & C)-III ------ 02/ 02.12.2025 By filing this writ petition, the petitioners have prayed for the following reliefs:- “For issuance of an appropriate writ(s), order(s) or direction(s) particularly in the nature of mandamus 2025:JHHC:36021 2 commanding upon the respondents to immediately and forthwith make payment of difference of arrears of salary to the petitioners along wit interest and cost of litigation as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case in light of the Office Order No. 15 r/w Memo No. 113 dated 30.1.2017 (Annexure-I), especially taking into consideration the relevant facts as all the other similarly situated employees appointed along with the petitioners and/or even before or after these petitioner, they all have been granted/ extended the benefits admissible under law whereas the case of these petitioners has been discriminated without assigning any cogent or convincing reason for the same and even after more than two years from the date of their superannuation/ resignation.” 2. Heard learned counsel representing the petitioners and learned counsel representing the respondents. 3. Learned counsel representing the petitioners submits that the petitioners’ claim for higher pay scale is not being considered by the respondents, though a decision has been taken in respect of the other similarly situated employees. He refers to document annexed as Annexure-5 to this writ petition. He submits that the petitioners whose case is similarly situated, are entitled to get the same benefit. He lastly submits that a detailed representation has been filed but the same is yet to be disposed of. 4. Learned counsel representing the respondents submits that if the petitioners file a fresh representation individually, annexing the copy of Annexure-5 of this writ petition, and other documents, which according to the petitioners are in their support, the same will be looked into and an appropriate order will be passed, considering the eligibility of the petitioners. 5. After hearing the parties, I direct the petitioners to file a 2025:JHHC:36021 3 fresh individual representation before the respondent – Directorate of Municipal Administration, Urban Development & Housing Department, Government of Jharkhand, along with all the documents, within four weeks. 6. On receipt of such representations, the respondent – Directorate of Municipal Administration, Urban Development & Housing Department, Government of Jharkhand, will consider the case of the petitioner and pass an appropriate order, within six weeks. 7. If the petitioners are found entitled for the relief, the same shall be extended to them within two weeks thereafter. 8. If any part of the claim / representation of the petitioners is rejected, the reasons thereof must be communicated to the petitioners within the aforesaid period. 9.
