The defendant-State of Haryana assails the correctness of concurrent findings of fact arrived at by the Courts below while decreeing plaintiff’s suit for declaration to the effect that he is entitled to be promoted to rank of Pump Operator, Grade II with effect from 16.07.1982 along with payment of arrears of salary along with all consequential benefits. Both the Courts found that Sh. Chander Singh, a junior to the respondent was promoted in the year 1988 with effect from 16.07.1982, hence, the respondent was also entitled to be promoted. 2. Learned counsel for the appellant submits that the suit was filed on 09.01.1989 for grant of decree of declaration and hence, it was beyond the prescribed time. 3. This Court has considered the submissions of learned counsel for the parties. 4. The cause of action accrued to the respondent in the year 1988 when Sh. Chander Singh was promoted.
