By this petition, petitioner herein has sought jurisdiction of this Court vested under Article 227 of the Constitution of India, seeking direction upon Judicial Magistrate 1st Class, Mendhar to decide the application dated 15.07.2023, filed by the petitioner\ under Section 175(3) BNSS, 2023, titled
“Shahim Ahmed versus Sandeep Kumar 7 Ors.” On 21.07.2025, Mr. Yasir Farooq Baig, DYSP (P), who was present in person, states that report, in terms of order dated 07.07.2025, has already been submitted before the Court of learned Judicial Magistrate, 1st Class, Mendhar. On the same day, learned counsel appearing on behalf of the petitioner withdrew his Power of Attorney on account of the fact that the petitioner had engaged some another counsel. Vide order dated 21.07.2025, this Court had directed learned Judicial Magistrate, 1st Class, Mendhar to submit a report in this regard. Today this case was called twice, however, nobody has chosen to appear. It is assumed that after submission of report by DYSP(P) before the Sr. No. 3

Court of learned Judicial Magistrate, 1st Class, the grievance of the petitioner has been redressed, as such, he has lost interest in prosecuting the instant case. In view of the above, the instant petition is dismissed for non- prosecution. Interim direction, if any, shall stand vacated.
