Heard learned counsel for the appellants, learned A.G.A. for the State, Sri Kripa Shanker Prasad, learned counsel for O.P. No. 2 and perused the record. This application has been filed for quashing of the cognizance order dated 26.08.2022 passed by Special Judge (SC/ST Act, Allahabad we well as charge sheet dated 07.04.2022 arising out of case crime No. 24 of 2022, under sections 452, 323, 504, 506 IPC and section 3(2)(Va) pf SC/ST Act, P.S. Holagarh, District Prayagraj in S.S.T. No. 328 of 2022. On perusal of the record, the Court finds that the allegations made in the first information report disclose commission of a cognizable offence and those allegations have found support from the material collected during the course of investigation on the basis whereof the police has laid a charge sheet against the appellants.Therefore, prayer for quashing the chargesheet as well as cognizance order stand refused. At this stage, in case appellants appear before the court below within 30 days from today and apply for bail, the same shall be heard and disposed of in accordance with law.
