Lalzekima, learned counsel for the respondent No. 1 and Mr. Zodinpuia Hnamte, learned counsel for the respondent Nos. 2, 3, 5 & 6. Mr. Zoramchhana, learned counsel for the appellant prays that he may be allowed to withdraw the appeal. Keeping in view the Order dated 19.05.2015 passed by the learned Trial Court in Civil Suit No. 51/2014, which states that the defendant No. 1 was present in the Court, the prayer of the appellant’s counsel is allowed. The appeal is accordingly dismissed, as withdrawn. Send back the Trial Court Record. It is needless to add that the appellant can challenge the impugned Judgment & Order passed by the learned Trial Court, as per law, but not on the Page No.# 3/3 ground that he had not received the summons issued by the learned Trial Court.
