Learned counsel for the parties are in agreement that the issue involved in the instant writ petition has been set a rest vide order dated 03.02.2025 passed by the Co-ordinate Bench of this Court in a batch of writ petitions led by S.B. Civil Writ Petition No. 12131/2023 (Pratap Ram Vs. State of Rajasthan & Anr.). 2. In view of the consensus between the counsel for the parties that the issue raised in the instant petition is squarely [2025:RJ-JP:36608] (2 of 2) [CW-5226/2025] covered by the decision in the case of Pratap Ram (Supra), this court deems it just and proper to dispose of the writ petition in the light of directions given in Para 20 of the aforesaid decision which is reproduced hereunder:- 20.Accordingly, in view of the discussion made herein above, the writ petitions are allowed in the following terms: (a). The candidature of the petitioners on the post of Assistant Teacher Level-I and II (English) shall be considered. The condition specified of Graduation in English medium in clause 3(1) of order dated 01.11.2022 is struck down. (b). The candidates/aspirants whose candidature has been rejected due to the condition imposed in the notification dated 01.11.2022 and advertisement dated 15.01.2023 shall also be eligible for the recruitment process initiated by the Department. (c). The teacher who have already been recruited till now will not be affected/disturbed since the only recruitment of English medium as a mandatory condition in the recruitment of Assistant Teacher Level I and II (English) is cancelled. 3. The aforesaid directions shall also apply in the case of the petitioner. 4. Ordered accordingly. (ANAND SHARMA),J NEERU /84
