(Oral) During proceedings of the case, learned counsel representing respondent No.2 made available communication dated 06.11.2025, issued by the Secretary of petitioner’s society to state that decision has already been taken by the petitioner-society to withdraw the case. He states that since Management Committee of the petitioner-society has already changed and new Committee in its meeting held on 06.11.2025 has decided not to purpure the case, this case can be disposed of.
2. Having taken note of aforesaid factum brought on record by the petitioner-society, this Court specifically called upon learned counsel for the petitioner to have instructions “whether present petition is maintainable or not?”.
3. On two occasions, i.e. 27.10.2025 and 07.11.2025, this Court granted time to learned counsel for the petitioner to have instructions. He states that despite repeated communications, none has come forward to impart instructions, as such, this Court may pass appropriate orders. Since learned counsel for the petitioner have no instructions, coupled with the fact that bare perusal of communication dated 06.11.2025, which has been addressed to this Court by Secretary of petitioner-society clearly reveals that new Management Committee of the petitioner-society has decided not to pursue the case and get the proceedings closed, this Court sees no necessity to keep the present petition alive and accordingly, the same is disposed of.
