1.
Learned counsel for the petitioner submits that the petitioner was appointed to the post of Teacher Grade-III, Level-II in the specially abled person (HI) Category. Learned counsel further submits that prior to issuance of the appointment order, the disability certificate earlier issued by the competent authority was taken into consideration, and he had also undergone a medical
[2025:RJ-JP:37389] (2 of 3) [CW-13951/2025] test by the competent Medical Board; however, on the basis of some anonymous complaint, the petitioner was directed to again undergo a medical test. After conducting medical tests, a press note dated 06.08.2025 has been issued by the Special Operations Group (S.O.G.) pointing out that the petitioner is having 0% disability, whereas, as per his earlier certificate, he was possessing disability of more than 40%.
2.
Learned counsel for the petitioner also submits that the petitioner has a reasonable apprehension that the respondents may not confirm the services of the petitioner, who is presently a probationer trainee, and may terminate his service without affording any opportunity of hearing. This apprehension is based on the aforesaid press note dated 06.08.2025, whereas the document showing his disability as 0% has not been supplied to him. He further submits that in a writ petition of an identical nature in Ranjeet Singh Vs. State of Rajasthan1 a Co-ordinate Bench of this Court had granted relief to the similarly placed petitioner therein.
3. Heard the submissions made at bar and perused the material available on record.
4. A bare perusal of the order in Ranjeet Singh (Supra) reveals that the facts therein are identical to the instant writ petition, and the directions issued therein are squarely applicable to the present case.
5. Accordingly, this Court deems it proper to dispose of the present writ petition in terms of the directions issued in Ranjeet Singh (Supra) as under: 1 S.B.C.W.P. No. 13179/2025
[2025:RJ-JP:37389] (3 of 3) [CW-13951/2025]
"4. Admittedly, at present no notice or order intending to dispense with/discharge/terminate the service of the petitioner has yet been issued by the respondent- Administrative Department.
5. Under these circumstances, this Court deems it just and proper to direct the respondents No. 1 to 3 that in case, they intend to take any coercive action against the petitioner, on the basis of Revised Medical Board report as well as press note dated 06.08.2025, then they will issue show cause notice along with copy of Revised Medical Board report, requiring the petitioner to submit his representation against such report of Revised Medical Board and no action shall be taken against the petitioner without giving him personal opportunity of hearing.
6. It is made clear that no view has been expressed by this Court on the merits of the case."
6. In view of the above directions, the writ petition stands
disposed of.
7. All pending application(s), if any, stand(s) disposed of.
