IN THE HIGH COURT OF JHARKHAND AT RANCHI
L.P.A. No. 612 of 2025
M/s. Tata Steel Limited, having its registered office at 24, Homi Mody Street, Fort Mumbai, having its works at Jamshedpur, through Mr. Rajesh Kumar Jha
… … Appellant
Versus
1. The State of Jharkhand, through the Secretary, Department of Labour, Employment, Training and Skill Development, Government of Jharkhand, Ranchi
2. The Deputy Labour Commissioner, Jamshedpur, Department of Labour, Employment, Training and Skill Development, Government of Jharkhand, Jamshedpur
3. Ramesh Kumar Roy, S/o Mr. R.N. Rai, R/o Qr. No. 13, L-4 Type, Road No. 13, Kadma Farm Area, Jamshedpur... Respondents
CORAM:
HON’BLE THE CHIEF JUSTICE
HON'BLE MR. JUSTICE RAJESH SHANKAR ----- For the Appellant
: Mr. Raunak Sahay, Advocate For the Respondents
: -----
Order No. 03
Dated: 27.11.2025
Learned counsel for the appellant states that he may be permitted to withdraw the instant appeal at this stage reserving liberty to the appellant to raise all the questions before the Labour Court, Jamshedpur.
2.
From the impugned order, we find that the learned Writ Court has imposed a cost of Rs.10,000/- upon the petitioner/appellant which, according to us, is not warranted as no notice in the petition had in fact been issued to the workman and even otherwise it cannot be held that the issues raised by the appellant were not contentious enough, though it is entirely a different matter that the petition has been dismissed on the basis of certain judgments rendered by the Hon’ble Supreme Court.
3.
In the given facts and circumstances, we deem it appropriate to set-aside the order dated 01.08.2025 passed in W.P.(L)
2025:JHHC:35371-DB 2
No. 3175 of 2025 so far as it relates to the imposition of cost of Rs.10,000/-.
4.
The instant appeal is dismissed as withdrawn with aforesaid liberty.
5.
Pending interlocutory application(s), if any, also stands
disposed of.
