Order 28/10/2025
1. The short controversy in the matter as submitted by learned counsel for the petitioner is that the petitioner is aggrieved by the
order dated 01.07.2025 (Annexure-3) qua which it is submitted that for non- compliance of deposit of cost as awarded and the litigation pertaining to year 2015, her petition was dismissed without hearing the merits of the case.
2.
Learned counsel for the petitioner submitted that the matter is high on merits and the petitioner has also deposited the cost but with a slight delay. It is further submitted that a sympathetic approach be adopted, as merits should not be suppressed on ac- count of procedural delays, moreover, due to fault of the counsel arguing the matter before learned trial Court.
