1. By way of this petition, the petitioner has prayed for following reliefs:-
“10.1 That this Hon'ble Court may kindly be pleased to issue
an
appropriate
writ,
thereby setting-aside/quashing the impugned order dated 23.06.2023 (Annexure P/1) and further be pleased to direct the respondent authorities to appoint the petitioner on the post of Kotwar, Gram Panchayat, Ganiyari, in accordance with law. 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”
2. Learned counsel for the petitioner submits that the present petition was preferred seeking relief with respect to the appointment of the petitioner to the post of Kotwar. He further submits that in view of the fact that the petitioner has now
3 crossed the age of 58 years, the question of making such appointment at this stage does not arise. He further submits that in light of the advanced age of the petitioner and the long passage of time since the filing of the petition, the very relief prayed for has lost its efficacy. Consequently, the petition has been rendered infructuous by efflux of time and no useful purpose would be served by keeping it pending any further.
3. Learned counsel for the respondents agreed with the
submissions made by the counsel for the petitioner and has no objection.
4. Accordingly, the present writ petition is dismissed as having become infructuous.
