1. Heard Mr. Anurag Singh, learned counsel for the petitioner. Also heard Mr. S. S. Baghel, Dy. Govt. Advocate for the Respondent/State.
2. The present writ petition has been filed by the petitioner with the following prayers
" 1. That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions to respondent no.5 to comply with the order dated 09.04.2024 passed by Chief Judicial Magistrate, Ambikapur, District Surguja (C.G.) and submit preliminary report within stipulated period of three months in the interest of justice.
2. That, this Hon'ble court may kindly be pleased to issue a writ /writs, order/orders, direction/directions to expedite the proceedings of complaint case pending before Chief Judicial Magistrate, Ambikapur, District Surguja (C.G.) within period of Six Months in the interest of justice.
3. That, this Hon'ble Court may kindly be pleased to grant any other relief, which it deems fit and proper."

Learned counsel for the petitioner prays for withdrawal of this writ petition with liberty to take recourse to law under Section 482 of Cr.P.C. before the competent Court.
4. In view of the above, the present writ petition is dismissed as withdrawn with the liberty to file before appropriate Bench.
5. Certified copy, if any, filed in the petition be return back to the petitioner after retaining its attested true copy.
