The present criminal misc. application has been filed under Section 379 of BNS by the applicant/respondent no. 1 Anjali Ahuja. In the application, it is alleged that the affidavit dated 14.06.2025 filed by the petitioner in WPMS No.1766 of 2025 is a false affidavit before this Court as it shows her presence before the Oath Commissioner on 14.06.2025, whereas, on that date, she was present in Srinagar, Pauri Garhwal. This fact has been corroborated by the applicant/respondent no. 1 through the photographs and C.D. 4. Learned counsel for the petitioner has filed objection to this application stating that in paragraph nos. 16 and 17 of the affidavit filed in support of the objection to the present criminal misc. application, the petitioner has categorically stated that due to inadvertent mistake, the date of swearing of the affidavit was incorrectly mentioned. She further tendered her unconditional apology for the same. 5. Having considered the submissions and after perusing the materials available on record and also considering the fact that due to inadvertent mistake, the date of swearing of the affidavit was incorrectly mentioned, the present criminal misc. application stands disposed of.
