This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of Cr.M.P. No. 2405 of 2024 to its original file. Learned counsel for the petitioner submits that Cr.M.P. No. 2405 of 2024 was dismissed for non-compliance of the peremptory order of this Court dated 30.08.2024 to file a supplementary affidavit within four weeks showing proof of deposit of Rs.2,85,857/- with the Executive Engineer, JBVNL, Chatra. It is next submitted that as the petitioner could not collect the said amount to be deposited with the Executive Engineer, JBVNL, Chatra, the said supplementary affidavit could not be filed within the stipulated time, resulting in dismissal of Cr.M.P. No. 2405 of 2024. It is next submitted that the petitioner has very good grounds to agitate in the said Cr.M.P. No. 2405 of 2024 and unless Cr.M.P. No. 2405 of 2024 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the Cr.M.P. No. 2405 of 2024 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, Cr.M.P. No. 2405 of 2024 is restored to its original file to the stage at which, it was before its dismissal.
