ORDER : This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“.... to issue a Writ, one in the nature of Writ of Mandamus or any other appropriate Writ, Direction or Order declaring the action of the 3rd respondent in imposing the Condition No.3 in Endorsement bearing B.A.No.571/G2/2014, dated 28.08.2014 directing the Petitioner to produce Conversion proceedings or No Objection Certificate from the Revenue Divisional Officer for the construction permission applied by the Petitioner in respect of property bearing Tirupati Village accounts Survey No.3/2C/2E2/A4, Tirupati Municipal Ward No.19, Narayanapuram (Parvathipuram) residential area vacant site and Door No.19-13-45/5, ACC shed measuring 4980.36 sq.yards situated at Tirupati Urban Mandal, Chittoor district as illegal, contrary to law and without jurisdiction and set aside the said condition and consequently direct the 3rd Respondent authority to grant approval of construction permission without reference to the said condition No.(3) mentioned in Endorsement bearing B.A.No.571/G2/2014, dated 28.08.2014 …...”

Heard learned counsel for the petitioners, learned Government Pleader for Municipal Administration and Urban Development for respondent No.1, Mr.A.S.C.Bose, learned Standing Counsel for respondent No.2 and Mr.P.Muni Reddy, learned Standing Counsel for respondent No.3 and the learned Standing Counsel for Municipal Corporation for respondent. 3. Today, when the matter came up for hearing, learned Standing Counsel representing the 2nd respondent furnished a copy of the instructions of the Deputy City Planner, Municipal Corporation, Tirupati dated 06.01.2025, wherein it is stated that the petitioner has constructed stilt + 5 floors apartment

building in Sy.No.3/2C/2E2, Tirupati village, Municipal Ward No.19, Narayanapuram (Parvathipuram) Residential area, under the name and style of ‘Srinivasa Castle’ in accordance with the Building Permission obtained from the Corporation vide B.A.No.571/G2/2014. At present, there is no dispute regarding the said apartment, bearing Door No.19-13-45/5, which is existing stilt + 5 floors residential building. The building permission was also granted on 08.04.2015, vide B.A.No.571/G2/2014.
4. In view of the above instructions, this Court feels that no further cause survives in this writ petition. 5. Accordingly, the Writ Petition is dismissed as infructuous.
