18.09.2025 1 Heard Mr. Raj Bahadur Singh, learned counsel for the petitioner, Mr. Malay Jain, learned Panel Lawyer for the State/respondent No.1 and Mr. Navin Shukla, learned counsel for respondent No.2. 2 The present petition has been filed by the petitioner with the following relief(s):-
“It is, therefore, prayed that this Hon'ble Court may kindly be pleased to allow this petition and consequently quash the charge sheet bearing No. 59/2021 dated 15.09.2021, arising out of FIR No. 21/2021 dated 17.02.2021 by the Mahila Police Station, Sector-VI, Bhilai, Distt. Durg (C.G.) for the alleged offence U/s. 498-A r/w 34 of IPC. Also all the consequential criminal proceeding (Reg. Cr. Case No. 8434/2021) arising out of the aforesaid Final Report / FIR, pending before the Judicial Magistrate First Class (Durg), may also be quashed. Any other relief, which this Hon'ble Court may deem fit in the obtaining factual matrix may also be passed in favour of petitioners, to secure the ends of justice.”

Learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, as charges have already been framed against the petitioners, the examination-in- chief of the victim has been recorded, and the matter now stands posted for further hearing on 17.10.2025. 4
Learned counsel for respondent No.2 concurs with the
submissions advanced on behalf of the petitioner. 5 The prayer so made appears to be fair and reasonable. 6 Accordingly, the instant petition is dismissed as withdrawn. However, it shall be open to the petitioner to avail such remedy as may be available to him in accordance with law, if and when occasion so arises. Sd/- Sd/-
