JUSTICE ANOOP KUMAR DHAND Order 19/08/2025
1. Counsel submits that certain part of the pasture land and Kabristan land has been encroached by the encroachers, for which a complaint has been submitted by the petitioners before the concerned authority. Counsel submits that though notices have been issued to the encroachers, but no proceedings have been initiated against them, hence, interference of this Court is warranted. Counsel submits that
(2 of 2) [CW-10886/2025] before approaching this Court, the petitioners have already submitted several representations in the office of the respondents for doing needful exercise, but till date, no such exercise has been initiated, hence, the petitioners approached this Court.
2. Considering the above, but without going into the controversy involved in the matter that as to whether any subject land has been encroached or not and looking to the fact that the petitioners have already filed several complaints/representations before the respondents, it is expected from them to decide the same strictly in accordance with law, after affording due opportunity of hearing to all the respective parties, expeditiously as early as possible.
3. Before parting with this order, it is made clear that this Court has not issued any order/direction to the respondents to decide the representation(s) of the petitioners in a particular way. The same would be decided strictly in accordance with law by passing a reasoned and speaking order after affording due opportunity of hearing to all the respective parties.
4. With the aforesaid observations/directions, the instant writ petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of.
