GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ order or a direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos 2 and 3 in not registering my complaint dated 24 08 2024 against the unofficial respondent for his unlawful activities of repeated trespass 2 damage to the house property bearing D No 42813/2 Rambha Vari Street Near Railway Gate Dilipsingh Peta alias Kothapeta Rajamahendravaram besides threatening with dire consequences in spite of my representations dated 17 10 2024 and 25 11 2024 as illegal irregular arbitrary and violation of the Bharatiya Nagarik Suraksha Sanhita BNSS 2023 and also offends Articles 14 21 and 300A of Constitution of India and consequently direct the 3rd respondent to take ipprcphate action against the unofficial respondent by registering my complaint dated 24 08 2024 as a case in crime.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that the disputes between the petitioners and the unofficial respondent are civil in nature. 3. For ready reference, the written instructions are extracted hereunder: “ I submit that the petitioner sated that he already reported about the issue of illegal constructions to the Rajamahendravaram Municipal Corporation authorities. I further advise the both petitioner and respondent to solve the matter amicably by consulting concerned authorities, as the matter comes under civil in nature.” 4. In that view, the Writ Petition is disposed of. However, the Petitioners are at liberty to work out their remedies before appropriate forum in accordance with law. There shall be no order as to costs.
