And 5 Others Counsel for Petitioner :- Mahendra Pratap Singh Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
1. Heard learned counsel for the petitioners and learned A.G.A. for the State- respondents.
2. The present writ petition has been filed with a prayer to issue a writ, order, rule, or direction in the nature of Mandamus, directing respondent no. 2 to register the First Information Report of petitioner no. 2 and to conduct investigation in accordance with law.
3. After substantial arguments, we posed a pointed query to the learned counsel for the petitioners as to what prompted the filing of the instant writ petition; however, no satisfactory response was furnished.
4. Learned A.G.A. has opposed the writ petition and submitted that there exists no cause of action for instituting the writ petition or for seeking the lodging of an FIR, as the petitioner is a persona non grata in the service matter.
5. Confronted with this situation, when we were inclined to dismiss the writ petition with exemplary costs, learned counsel for the petitioners requested that the writ petition may be dismissed as not pressed.
6. Accordingly, the writ petition is dismissed as not pressed. Order Date :- 17.4.2025 NLY (Prashant Kumar,J.) (Mahesh Chandra Tripathi,J.) Digitally signed by :- NAND LAL YADAV High Court of Judicature at Allahabad
