ORDER:
This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India seeking Mandamus, for the following relief:
“…to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 to 4 herein in not considering the representation of the petitioner dated 02.12.2024 as illegal, arbitrary and unconstitutional and consequently direct the respondents 2 to 4 to take action against the Respondents 5 to 8 for removing the unauthorized and illegally constructed shops in the cellar parking place of the Apartment complex in violation of the approved building plan B.A.NO:184/97/ACP-ll dated 07.06.98…”
2. The present writ petition is filed challenging the action of the respondent No.2 in not initiating any action on his complaint made on 02.12.2024 requesting for demolition of the shops which were constructed illegally in the housing complex.
3. On a perusal of the document filed by the petitioner, it appears that vide endorsement VSP202412023807, ZONE-III, dated 02.12.2024, through Public Grievance Redressal System (PGRS), the petitioner’s complaint dated 02.12.2024 was already considered and it was resolved. The staff of the Town Planning Department has inspected the shop at the field level and a notice was also issued to illegally constructed shop owners. As the complaint raised by the petitioner was already addressed by the 2nd respondent vide endorsement VSP202412023807, ZONE-III, dated 02.12.2024, no further cause survives.
4. In view of the same, the Writ Petition is dismissed as infructuous. No
order as to costs.
