JUSTICE LALITHA KANNEGANTI Digitally signed by MEGHA MOHAN Location: HIGH COURT OF KARNATAKA - 2 - NC: 2025:KHC:15652 CP No. 535 of 2024 ORAL ORDER The present petition is filed by the petitioner-wife seeking transfer of M.C.No.6/2024 filed by the respondent/husband pending on the file of the III Additional Principal Family Judge, Bengaluru to the file of the I Additional Senior Civil Judge, Mandya where the Crl.Misc.No.258/ filed by the wife is pending. 2. The facts of the case are that the marriage between the parties was solemnized on 29.04.2021 at Mandya. In light of the disputes between the parties, the respondent had filed MC No.6/2024 on the file of the III Additional Principal Family Judge at Bengaluru on 02.01.2024. The wife had filed Criminal Miscellaneous No.258/2024 on the file of the I Additional Senior Civil Judge, Mandya on 20.11.2024. It is submitted that the distance between the both places is more than 100 kilometers and it is difficult for the wife to travel all the way from Mandya to Bangalore. 3. On the last occasion, the learned counsel appearing for the petitioner/wife was present and there was no representation on behalf of the counsel appearing for the respondent/husband. Having heard the counsel for the petitioner/wife, the matter was directed to be listed under the - 3 - NC: 2025:KHC:15652 CP No. 535 of 2024 caption “Part Heard”. Today, also, there is no representation on behalf of the respondent. 4. Considering the fact that Crl.Misc.No.258/2024 is pending at I Additional Senior Civil Judge Court at Mandya and the distance is about 100 kilometers and the inconvenience being caused to the petitioner, this Court deems it appropriate to pass the following: ORDER i. M.C.No.6/2024 pending on the file of the III Additional Principal Family Judge, Bengaluru is withdrawn and transferred to the I Additional Senior Civil Judge, Mandya. ii. The petitioner/wife shall co-operate with the trial and shall not seek unnecessary adjournments. iii. Accordingly, the Civil Petition is Allowed. iv.
