BEFORE HONOURABLE MR. JUSTICE MRIDUL KUMAR KALITA ORDER 27.07.2026 [1] Heard Mr. K.K. Bhatta, the learned counsel for the applicant. Also heard Mr. D. Mondal, the learned counsel for the claimants. [2] This application under Section 5 of the Limitation Act, 1963 has been preferred by the applicant/insurance company praying for condonation of delay of 34 days in preferring the connected MACAppeal. [3] The applicant has stated the reasons for delay in paragraph Nos. 3 to 5 of the instant interlocutory application. Mr. D. Mondal, the learned counsel for the opposite party submits that considering the grounds stated as well as short period of delay, the claimants does not have any objection if the delay is condoned. Page No.# 3/3 [4] I have considered the submissions made by the learned counsel for both sides and have considered the grounds stated in the instant memo of appeal. [5] Considering the said grounds to be sufficient cause which prevented the applicant in preferring the connected MACAppeal within prescribed period of limitation, the period of delay of 34 days in preferring the connected MACAppeal. [6] The connected MACAppeal is hereby condoned and this interlocutory application is allowed. [7] The Registry is directed to register the connected MACAppeal and list the same for admission after a week on a date to be fixed it. [8] The name of Mr.
