This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 84 of 2025 registered at Police Station Bango, District Korba (CG) for the offences under Sections 376(2)(n), 376(2)(i), 376(2)(f) of IPC and Sections 4, 6 of POCSO Act. 2. The prosecution story, in brief, is that the victim had lodged the written report alleging that from 28.05.2022, the applicant used to forcibly commit sexual intercourse with her on the pretext of marriage thereby offence has been committed. Learned counsel for the applicant submits that there was love affairs between the victim and the applicant and the family members of the prosecutrix are not ready for marriage, therefore, due to pressure of victim’s family members, report was lodged against him. He next submits submits that the date of birth of victim is stated to be 14.04.2007 and she became major when the FIR was registered on 13.06.2025 and further there is inordinate delay in filing the FIR. He submits that the applicant is in jail since 13.06.2025, charge sheet has been filed, there are total 14 prosecution witnesses to be examined and there is no immediate possibility of disposal of case, therefore, the applicant may be enlarged on bail. 4. Per contra, learned State Counsel opposes the bail application. 5. The victim/complainant is represented by counsel T. R. Patel, Advocate and got recorded no-objection to grant bail. 6. Having considered the submissions made by learned counsel for the parties and looking to the age of victim as on the date of registration of FIR, without commenting anything on the merits of the case, I am inclined to release the applicant on regular bail at this stage. 7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the sanctification of the trial Court for his appearance before the said Court as and when directed. 8.
