The Court made the following ORDER:
This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking anticipatory bail, in connection with NDPS SC No.33 of 2021 on the file of the learned I Additional District and Sessions Judge, East Godavari district, at Rajahmundry, arising out of Crime No.34 of 2020 of Mothugudem Police

Station, East Godavari district, registered for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
2. Case of the prosecution, in brief, is that on 27.07.2020, at about 06.30 PM, the Sub-Inspector of Police, Mothugudem Police Station, along with his staff and mediators, while conducting vehicle checking at Sri Daralamma Temple, outskirts of Polluru village, Chinturu Mandal, found A2 to A4 in possession and illegal transportation of 200 KGs of Ganja in Swift Dzire Car bearing registration No.AP 31 BA 9918. A2 to A4 confessed that they were transporting Ganja on the directions of A1. The contraband, along with vehicle and other material, was seized under cover of a mediators report and a case has been registered against the accused.

4. The quantity of contraband allegedly seized from the possession of the accused is 200 Kgs of Ganja, which is a commercial quantity. Learned Assistant Public Prosecutor

submitted that the police, after conducting investigation, filed charge sheet, which is taken on file as NDPS SC No.33 of 2021 on the file of the learned I Additional District and Sessions Judge, East Godavari district, at Rajahmundry, and hence the petitioner is not entitled for anticipatory bail. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner herein.
5. Accordingly, the Criminal Petition is dismissed.
