[2025:RJ-JP:42070] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous (Petition) No.8093/2019 Ramraj S/o Babulal, R/o Aada Dungar, P.S. Sapotara, District Karauli, Raj. ----Petitioner Versus 1. State of Rajasthan through P.P. 2. Gallo Devi W/o Ramraj, D/o Pharebi, R/o Pahari, P.S. Balghat, District Karauli, Raj. ----Respondents For Petitioner(s) : Mr. Pramod K. Thakwani on behalf of Mr. Girraj Prasad Gadhwal For Respondent(s) : Mr. Vivek Choudhary, PP HON'BLE MR. JUSTICE ANAND SHARMA Order 14/10/2025 1. The instant criminal miscellaneous petition has been filed by the petitioner feeling aggrieved by order dated 22.05.2019 passed by the Civil Judge & Judicial Magistrate, Todabheem, Rajasthan, whereby interim maintenance @ Rs. 2,500/- per month has been determined and the petitioner-husband was directed to pay the same to the respondent-wife. 2. It has been submitted by the learned counsel for the petitioner that order dated 22.05.2019 passed by the learned Court below is against the facts of the case, material on record and law prevailing at the relevant time and even the income of the petitioner-husband has not been correctly appreciated by the learned Court below. [2025:RJ-JP:42070] (2 of 2) [CRLMP-8093/2019] 3. I have perused the order dated 22.05.2019 passed by the learned Court below and it reflects from the order itself that the respondent-wife was deserted by the petitioner-husband for no good reasons and so far as income of the petitioner is concerned, it has come on record that the monthly income of the petitioner was Rs.60,000/- per month, however, the same was disputed by the petitioner-husband. 4. Under these circumstances, granting interim maintenance of Rs.2,500/- per month to respondent-wife is totally justified and I find no error whatsoever in the impugned order dated 22.05.2019 passed by the learned Court below. 5. Accordingly, the instant Criminal Miscellaneous Petition stands dismissed. (ANAND SHARMA),J DAKSH/2
