Mr. Nivesh Bahuguna, learned counsel for the petitioner. 2. Mr. Rajeev Singh Bisht, learned Additional C.S.C. for the State of Uttarakhand. 3. Petitioners were appointed as Assistant Teachers in Elementary Education Department. According to them, they are entitled to benefit of promotion pay scale as per Government Policy, however, the said benefit has not been given to them. 4. By means of this writ petition, petitioners have sought the following reliefs:- (i) To issue a writ order or direction in the nature of mandamus commanding the Respondents to forthwith grant the benefit of Promotion Pay Scale (Grade Pay of R. 5400/-) to the petitioners from due date, details whereof is given in Para 6 of the writ petition, along with arrears of the same from respective due dates. (ii) Issue any suitable writ, order or direction commanding the respondents to consider the fixation of the pension of the petitioners by granting Grade Pay of Rs. 5400 with effect from the due date to the petitioners who are soon to be retired. 5. Learned counsel for the petitioner relies upon a judgment dated 11.04.2017 rendered by coordinate Bench in WPSS No. 602 of 2014 and he submits that the issued involved in this writ petition had already been decided in 2025:UHC:8501 the said judgment. 6. Mr. Rajeev Singh Bisht, learned State Counsel, on instructions, submits that the controversy involved in this writ petition is identical to the one decided in WPSS No. 602 of 2014, therefore, this writ petition can be decided in terms of the said judgment. 7. Accordingly, the writ petition is decided in terms of the judgment dated 11.04.2017 passed in WPSS No. 602 of 2014.
