1. The applicant has preferred this 1st bail application under Section 483 of BNSS, 2023 for grant of regular bail as she is arrested in connection with crime No. 255/2024, registered at Police Station – Purani Basti, District- Raipur (C.G.) for offence punishable under Section 302 & 201 of IPC. 2. 2 body in River Kharun, near Kesari Bagicha, Bhathagaon. The body was retrieved, and a merg (inquest) inquiry was initiated. During the merg inquiry, the deceased was identified as Vidhata Yadav. As per the post- mortem report, the cause of death was found to be head injury, whereupon an offence under Sections 302 and 201 of the Indian Penal Code was registered against an unknown accused and investigation commenced. During the course of investigation, the family members of the deceased disclosed that the wife of the deceased, accused Meena Yadav, was having an illicit relationship with co-accused Amjad Khan. Upon taking co-accused Amjad Khan into custody, his memorandum statement was recorded, wherein he disclosed that, at the instance of Meena Yadav, a plan was hatched along with co-accused Annu Prajapati to eliminate the deceased. In furtherance of the said conspiracy, on the night of 09.06.2024, the deceased Vidhata Yadav was lured on the pretext of a liquor party and taken in an auto-rickshaw by Annu Prajapati to Kharun River Bridge, Kesari Bagicha, Bhathagaon, where he was assaulted on the back of the head with an iron rod, resulting in his death, and thereafter the dead body was thrown into the river. Based on above, offence has been registered against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question.
There is nothing on record against the applicant nor there is any seizure made from her. The FIR was lodged against unknown person. He further submits that the applicant is a lady and is in jail since 10.06.2024, there are total 24 prosecution witnesses, out of which 6 have been examined till date and all of them have been turned hostile. The trial is likely to take time to be finalized, therefore, it is prayed that the applicant may be enlarged on bail. 4. Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that the matter is of circumstantial evidence against the applicant, therefore, looking to the nature of offence, the applicant may not be released on bail. 5. I have heard learned Counsel appearing for the parties and perused the material available on record. 3

Considering the facts and circumstances of the case, evidence collected by the prosecution against the applicant, the nature of offence and the fact that key witnesses are remain to be examined, without further commenting on merits of the case, at this stage, I am not inclined to release the applicant on bail. 7. Accordingly, the bail application is rejected. However, considering the fact that out of 24 prosecution witnesses, only 6 have been examined till date and the applicant is in jail since 15.06.2024, the concerned Trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible preferably within a period of 5 months from today.
