Case No.104 of 2021 instituted under Section 304 B of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail. This is the second journey of the petitioners with the prayer for anticipatory bail, earlier the prayer for anticipatory bail of the petitioner no.1 was rejected vide order dated 09.09.2021 in A.B.A. No.6435 of 2021 and petitioner no.2 was rejected vide order dated 21.09.2021 in A.B.A. No.6986 of 2021. Learned counsel for the petitioners submits that the fresh ground is that, in the meanwhile, the trial of the co-accused son of the petitioner no.1 has been completed and he has been acquitted vide judgment dated 19.03.2025 in S.T. No.353 of 2021 passed by the learned Additional Judicial Commissioner-XX, Ranchi. Drawing attention of this Court to the depositions of the witnesses in that trial, learned counsel for the petitioners submits that PW-1 to 4 who are the material witnesses of the case were all declared hostile as they did not support the case of the prosecution. It is next submitted that PW-1 in para-10, PW-2 in Para-10, PW-3 in Para-11 and PW-4 in Para-10 have all stated that the son of the petitioner no.1 and brother of the petitioner no.2 was pulling on well with his wife and having good relationship with her. Learned counsel for the informant submits that the informant has no objection for grant of anticipatory bail of the petitioners. Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant the privileges of anticipatory bail to the above-named petitioners.
