05/ 10.12.2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Rajrappa P.S. Case No. 183 of 2023, registered for the offence under Sections 385, 387, 420, 467, 468, 471 and 409 of the Indian Penal Code, pending in the court of learned S.D.J.M., Ramgarh.

Learned counsel appearing for the petitioner submits that this is a complaint case. He next submits that allegations are made that the petitioner has taken Rs. 3,10,000/- from the complainant/informant. He then submits that the petitioner has returned Rs. 1,10,000/- to the complainant. He submits that further allegation is made that for the rest two lakhs, two cheques amounting to Rs. 50,000/- each have already been issued to the complainant. He further submits that the matter has already been compromised and thereafter the complaint case has been lodged, which has been later on converted into the FIR pursuant to the court’s order.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there against the petitioner.

It has come in the impugned order of the learned Sessions

Judge that the petitioner has returned Rs. 1,10,000/- to the complainant/informant and further two cheques amounting to Rs. 50,000/- each have already been issued to the complainant. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Ramgarh, in connection with Rajrappa P.S. Case No. 183 of 2023, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
