R/CR.A/1253/2025 ORDER DATED: 09/05/2025 IN THE HIGH COURT OF GUJARAT AT AHMEDABAD R/CRIMINAL APPEAL (TEMPORARY BAIL) NO. 1253 of 2025 ========================================================== SUNNY KANTIBHAI PATNI Versus STATE OF GUJARAT & ANR. ========================================================== Appearance: THROUGH JAIL for the Appellant(s) No. 1 MR HK PATEL, APP for the Opponent(s)/Respondent(s) No. 1 ========================================================== CORAM:HONOURABLE MR. JUSTICE HASMUKH D. SUTHAR Date : 09/05/2025 ORAL ORDER [1.0] ADMIT. [2.0] The present appeal through jail has been preferred by the appellant requesting to release him on temporary bail on the ground of medical treatment of his father. [3.0] Having heard learned APP and perusing the order dated 21.03.2025 passed by the learned Additional Sessions Judge, Court No.16, Special Atrocity Court, City Civil Court, Ahmedabad in Criminal Misc. Application No.2196/2025, it appears that the appellant is facing charge for the offences punishable under Sections 302, 326 and 114 of the IPC and section 135(1) of the Gujarat Police Act and section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocity) Act and from perusal of the record it appears that jail record of the appellant in jail is not good and appellant has sought temporary bail to make financial arrangement for his family and for giving better medical treatment to his father and that grounds on which the R/CR.A/1253/2025 ORDER DATED: 09/05/2025 temporary bail is being sought for, are not sound, sufficient and satisfactory. Further, the trial is at the verge of completion and is kept on 12.05.2025 for final arguments. [4.0] Considering the aforesaid fact and the fact that time and again on the same ground the appellant has sought for temporary bail and has been denied by the learned Judge by assigning just and proper reasons, no case is made out to entertain the present appeal. Hence, present appeal stands dismissed. (HASMUKH D. SUTHAR, J.) Ajay Original copy of this order has been signed by the Hon'ble Judge.
