By way of filing this Criminal Miscellaneous Petition, the order of framing charges dated 01.09.2015 and the order of committal of case to Session Judge, Kota dated 09.10.2015 are under challenge. There was no stay in the instant Criminal Miscellaneous Petition and in the meanwhile, the trial has proceeded further. In compliance of the order dated 05.08.2025 earlier passed by the Co-ordinate Bench of this Court, status report dated 16.08.2025 has been sent by the District & Sessions Judge, Kota, which reflects that as on 16.08.2025, out of 37 witnesses, statements of 23 witnesses have already been recorded. Thus, in view of above, learned counsel for the petitioner does not press the Criminal Miscellaneous Petition with liberty to raise all such objections at appropriate stage.
