PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal petition, under sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking regular bail, in Crime No.236 of 2024 of Narsipatham Town Police Station, Anakapalli dl'strict. \.=®".- Ee.+ 2 2. A case has been registered against the petitioner herein and another for the offences punishable under Sections 103(1), 118(1 ) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, in brief, is that, on 17.ll.2024 at about 22.30 hours, the deceased and his friends lndala Sankar and Siyyadri Suresh were proceeding to Kotha Veedhi on Pulsar Bike of the deceased. At that time, Al and A2, who were consuming alcohol, stopped them and asked l'Tagubotu naa kodukuIIara ekkada nundi vastunnaru". On that ah altercation took place between them and left the place. Later, lndala Sankar dropped the deceased at his house and while he was returning, Al and A2 stopped the motor cycle and took the bike keys. On informing the same to the deceased, he went to the accused along with lndala Sankar. Then Al lit a cigarette and made injury on the left side of neck of lndala Sankar. Then A2 instigated Al to kill the deceased. On thaIAl took a nearby stick and beat the deceased on his head at left side. At that time, A2 hold the deceased tightly and then Al again beat the deceased twice on his body and caused death of the deceased. 4. Heard. Perused the record. {- \EH- \ EE •` +\+iir++++_ '3 5. A perusal of the material on record goes tO Show that On the date of incident an altercation took place between both the deceased and the accused, while they were in an intOX'ICated condition. ln the altercation, both of them received injuries. There is absolutely no explanation in the FIR as to how accused rece'lved injuries. Learned Assistant Public Prosecutor fairly subm'ltted that the accused too received fracture injury and there is no reference to that effect in the prosecution case. By virtue of the same, it can safely be inferred that the prosecution has suppressed the genesis of the attack.
