A case has been registered against the petl-tjoner and others for the offence under sect,Ions 318(4) B.N.S and 66-D I.T. Act. 3. Thecaseoftheprosecution isthat: The petitioner was working I-n MEPMA in Palamner Municipality and he introduced an App (websI-te/SOftware applicatl-on) called as fDATAMEER All to the rest-dents of Palamner in January 2024 and explained that I-f anybody deposits money Rs.1,000/-, would yield a return of Rs.43/- per day, and with this promise, he attracted people by suggesting to refer more indjvl'duals to joint the app and depositl-ng hl®gher amounts would result in greater returns. By believing the same the public in palamner and neighboring villagers deposl-ted the amount. Accordingly the informant R,Rajeswari and others deposited Rs.7,69,000/-. Learned Assistant Ptlblic Prosecutor submits that major pail of the investigation is completed except filing of charge sheet. 6. Without going intothe merits of the case, a perusal of the material available on record goes to show that the petitioner was arrested on 08.8.2024 and since then he has been in judicial remand. The petitioner is languishing in jail for more than 155 days. Police have not completed the investigation and not filed charge sheet. ln view of non-compliance of the provisions under Sec.187(3) of B.N.S., the petitioner is entitled for bail' 7. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner/A3 herein shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First class, Palamaneru; (ii) On release, the petitioner shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 05.OO p.m., till filing of charge sheet. 8.
