The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the order dated 3.5.2024 passed by Additional Principal Judge, Family Court No. 3, Aligarh in Maintenance Case No. 1636 of 2022 arising out of an application under Section 128, Cr.P.C., whereby recovery warrant has been issued against the applicant for the amount of Rs. 1,60,000/- After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. However, learned counsel for the applicant fairly argued that the applicant wants to pay the arrear of maintenance amount in installments. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
