Order on Board 25/07/2025
1. By way of the instant petition, the petitioners have prayed for the
3 / 4 following reliefs:- i. Issue a writ of mandamus or any other appropriate writ,
order or direction commanding the Respondents to forthwith issue individual bond posting orders to the Petitioners as per rules; ii. Direct the Respondents to treat the period from June 2025 till the actual date of posting as service for all purposes including payment of salary and bond period computation, in view of the delay being solely attributable to the Respondents; iii. Direct the Respondents to ensure that the Petitioners are not subjected to any penal consequences under the bond conditions for the delay caused by the administrative inaction of the Respondents themselves; iv. Direct the Respondent State/Authority to consider and decide the representations dated 08.07.2025 in a time bound manner and, consequently, direct the issuance of individual bond posting orders; v. Pass such other and further orders as this Hon’ble Court may deem just and proper in the interest of justice.
2. The grievance of the petitioners is that though the petitioners are qualified medical practitioners, who were admitted to three-year, full time postgraduate (MD/MS) courses in Government Medical Colleges of the State of Chhattisgarh through the National Eligibility-cum-Entrance Test-Postgraduate (NEET-PG) 2022 and the petitioners have successfully completed their respective courses and passed the final university examinations in the May-June 2025
4 / 4 and Chhattisgarh Post-Graduate Admission Rules, 2018 provides a compulsory Government/Rural Bonded Service of two years on every MD/MS student admitted to a Government College in the State despite that no posting orders have been issued to the petitioners.
3. Learned State counsel submits that the petitioners have filed the representations on 08 July, 2025 before the respondent authorities, which is still pending and they are ready to decide the said representation of the petitioners.
4. I have heard learned counsel for the parties at length and perused the documents with utmost circumspection.
