4.
Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of pelting stone upon the police personnel.
5. Looking to the contents of the FIR, it transpires that the FIR has been registered against 9 named persons and 100 unknown persons. The allegations are made of pelting stone upon the police personnel, which is general and omnibus against all the accused persons. Although two of the petitioners are named in the FIR, however allegations are similar against them also. The petitioners are having no criminal antecedents, as disclosed in paragraph 13 of this application. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.
6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih in connection with Bagodar P.S. Case No.43 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
