NC: 2025:KHC:6010 CRL.P No. 14480 of 2024 ORAL ORDER In this petition, the petitioner seeks the following reliefs:
"(i) Call for the concerned records; (ii) and quash the proceedings pending on the file of the XXXVIIth Additional Chief Judicial Magistrate at Bengaluru in C.C. No.31988/2024 in Crime No.0074/2024 registered by the (Basavanagudi) South Women Police Station, Bengaluru in taking cognizance of the offences punishable under Sections - 498-A, 506, 34 of IPC and 3 and 4 of Dowry Prohibition Act, against them. (iii) Pass such other suitable order / orders as this Hon'ble Court deems it appropriate in the admitted
facts and circumstances of the case, in the interest of justice and equity."
2. Heard learned counsel for the petitioners, learned Addl.SPP for respondent No.1 and perused the material on record. For the order proposed, Notice to respondent No.2 is dispensed with.

3. A perusal of the material on record will indicate that the respondent No.2 / complainant is the wife of petitioner No.1, while petitioner No.1 is mother of petitioner No.1.
4. In pursuance of the matrimonial disputes between petitioner No.1 and respondent No.2, an amicable settlement is arrived at between them in M.C.No.7030/2024 in which a settlement agreement dated 25.11.2024 was entered into between the parties. Clause No.(5) of the settlement arrived at between the parties, reads as under:
"5. In view of the settlement arrived between the parties the 2nd petitioner has agreed to close / quash the case filed in C.C. No.31988/2024 pending on the file of 37th Chief Judicial Magistrate Court, Bengaluru. The 1st petitioner has also agreed to withdraw complaint No.716/MC-3/D(PCN)/2024 filed against 2nd petitioner, her mother and brother before the Sanjaynagar Women's Police Station, Bengaluru dated 09.09.2024."

5. As can be seen from the aforesaid agreement entered into between the petitioner No.1 and respondent No.2, the petitioner No.1 has agreed to withdraw the impugned proceedings. So also, the respondent No.2 has agreed to close / quash the impugned C.C.No.31988/2024, which is the subject matter of the present petition.

In view of the aforesaid facts and circumstances and in view of the settlement arrived at between petitioner no.1 and respondent No.2 vide settlement agreement dated 25.11.2024, pursuant to which M.C.No.7030/2024 was disposed off, I'am of the view that in order to secure the ends of justice, the impugned proceedings deserves to the be quash.
7. In the result, I pass the following:
ORDER (i) Petition is hereby allowed. (ii) The impugned proceeding pending on the file of the XXXVIIth Additional Chief Judicial

No.31988/2024 in Crime No.0074/2024 registered by the (Basavanagudi) South Women Police Station, Bengaluru in taking cognizance of the offences punishable under Sections - 498-A, 506, 34 of IPC and 3 and 4 of Dowry Prohibition Act, insofar as the petitioners are concerned is hereby quashed.
