PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner herein, seeking anticipatory bail, in connection with Crime No.486 of 2024 of Madanapalle Rural Police Station, Annamayya district, registered for the offences punishable under Sections 191(2), 2 191(3), 329(3), 109(1), 118(1), 115(2) and 351(3) read with 190 of the Bharatiya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that, on 20.12.2024, at about 9.45 PM, the de facto complainant and his uncle went to his fields and questioned the accused about their fixing a banner at his fields. On that, the accused, armed with deadly weapons like iron rods, sticks and sickles, unlawfully trespassed into the lands of the de facto complainant and assaulted him and his uncle with an intention to kill them and caused bleeding injuries. The accused also threatened them with dire consequences. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that the petitioner herein is not arrayed as accused in the aforesaid crime. Learned Assistant Public Prosecutor too concurred that as on date, he has no instructions that the petitioner herein is arrayed as accused in the present Crime. When the petitioner is not arrayed as accused in the present crime, the question of granting anticipatory bail to him does not arise. 3 5. In view of the said reasons, the Criminal Petition is not maintainable and the same is, accordingly, dismissed. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. ________________________ K. SREENIVASA REDDY, J.
