Hindustan Petroleum Corporation Ltd. & Ors. Vs. Harpreet Singh Sabharwal & Anr. This application seeks condonation of delay of 25 days in filing the objections under Section 34(3) of the Arbitration and Conciliation Act, 1996 (in short ‘the Act’). Learned counsel on both sides are ad idem that in view of law laid down in Civil Appeal No.10970 of 2025 (Geojit Financial Services Ltd. Versus Sandeep Gurav), decided on 19.08.2025, the period of limitation for filing an application under Section 34(3) of the Act, where an application under Section 33 has been made, will commence from the date of disposal of such application, regardless of whether the application under Section 33 resulted in a correction, interpretation or additional award. In the instant case, the application under Section 33 had been made, which was decided on 12.03.2025. Admittedly, the objection petition has been preferred within the limitation period w.e.f. 12.03.2025. In view of above, the application is disposed of as the main petition has been filed within the time limit in terms of the decision in Geojit Financial Services Ltd., supra. The application stands disposed of. Arb. Case No. of 2025 Be registered. List for consideration alongwith Arb. Case No.318 of 2025 after six weeks. OMP No. of 2025 (OMPST No. 19064/2025) Be registered. Heard. Subject to deposit of entire awarded amount along with up-to-date interest in the Registry of this Court within a period of six weeks from today, operation and execution of the impugned award dated 14.12.2024, passed by the learned Arbitrator in Arbitration Case No.73 of 2018 (Harpreet Singh Sabharwal Versus Hindustan Petroleum Corporation Limited and others), shall remain stayed.
