Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. The writ petition is filed with the following prayer: "I. Issue a writ, order or direction in the nature of mandamus directing the respondents to release all retiral benefits including General Provident Fund, arrear of pension with interest and regular monthly pension whenever it false due within stipulated period." 3. It is submitted by learned counsel for petitioner that the claim of petitioner for retiral dues is pending consideration before respondent no. 3, however till date, no order has been passed. 4. Learned Standing Counsel submits that there is some amount, which is required to be deducted from dues as per the Principal of the institution and the matter is pending consideration. 5. Considering the facts and circumstances of the case, it is hereby provided that the respondent no.3 -Finance and Account Officer, Secondary Education, Jaunpur shall decide the claim of petitioner in accordance with law, preferably within a period of two months from the date of production of a certified copy of the order. If any amount is admitted by respondent being payable to petitioner, the same shall be released forthwith. The principle of nature justice shall be followed by respondent authority. 6. It is clarified that this Court has not decided the issue on merits and the authorities concerned shall independently apply its mind and pass order in accordance with law. 7.
