THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks for the following reliefs: a) Issue an appropriate writ/order in nature of certiorari, quashing the notification No.KSLU/Exam/PC/RV/CV/2024-25 issued by the fourth respondent dated 07.10.2024 at Annexure-A for the clause ‘Revaluation and Challenge valuation for the same Answer Book is not permitted’. b) Issue an appropriate writ/order or direction in nature of mandamus, directing the second - 3 - NC: 2025:KHC:10293 WP No. 34771 of 2024 respondent to allow the petitioner to apply for challenge valuation even after opting for revaluation in the subject environmental law for the exam held on 24.08.2024, as she is confident of scoring more than passing marks. c) Pass any other order/relief as this Hon’ble Court deems fit in the above said facts and circumstances, including an order as to cost, in the interest of Justice and Equity.” 2. Heard learned counsel for the petitioner, learned AGA for respondent No.1 and learned counsel for respondent Nos.2 and 4 and perused the material on record. Though respondent No.3 is served with notice, he has chosen to remain absent and has not contested the matter. 3. On 19.12.2024, this Court passed the following interim order: “1. Learned AGA is directed to accept notice for respondent No.1. 2. Sri.Girish Kumar, learned counsel is directed to accept notice for respondent Nos.2 and 4. 3. Issue emergent notice to respondent No.3 returnable by 01.02.2025. - 4 - NC: 2025:KHC:10293 WP No. 34771 of 2024 4. Respondent No.4 is directed to permit the petitioner to apply for challenge evaluation in the subject ‘Environmental studies’ as regards the examination held on 24.08.2024 which challenge evaluation will be subject to the result of the above petition. 5. Process fee and copies to be furnished by the end of day 20.12.2024 and in the meanwhile office objections to be complied with by 10.01.2025. 6. Relist on 10.01.2025.” 4. Learned counsel for the petitioner has filed a memo seeking leave of this Court to dispose of the petition on the ground that since results have been announced and petitioner has come out with flying colours, nothing survives in the said petition. The aforesaid memo reads as under: “The advocate for the petitioner states that the petitioner was a 3 years LL.B student. She was a topper in 1st, 3rd and 4th semester, in 6th semester in environmental studies subject unfortunately she got less marks of 25 out of 80 marks which was a fail as she was confident of getting better marks she applied for revaluation but only one mark was increased. The petitioner was confident of getting better marks for which she approached this Hon'ble court, this Hon'ble Court was pleased to grant ad interim order to apply for challenge revaluation. The petitioner then applied for the same and - 5 - NC: 2025:KHC:10293 WP No. 34771 of 2024 now the results are also announce and the petitioner has come out in flying colours. At this juncture nothing survives in the said petition. Hence the matter may be disposed off in the interest of justice and equity.” 5. Accordingly, in view of the memo, the petition is disposed of.
