Hon'ble Nalin Kumar Srivastava,J. 1. This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Complaint Case No.6431 of 2015 (Dr. Shalini Vs. Dr. Ravi Anand) under Sections 354, 323, 341, 504, 506 IPC, Police Station Swaroop Nagar, District Kanpur Nagar pending in the Court of Addl. Civil Judge (J.D.), Court No.8, Kanpur Nagar, expeditiously as early as possible. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It has been submitted by the learned counsel for the applicant that in the said complaint case, the applicant is an accused. The case is pending since more than 10 years. Earlier in this matter, final report was submitted by the police but the opposite party no.2 filed protest petition, which was treated as complaint. The opposite party is not cooperating with the court and regularly moving exemption application for appearance. Only dates are being fixed in the matter which is pending since long and it has not been decided as yet. The matter relates to the year 2015 and falls in the category of old cases. Therefore, prayer has been made to decide the aforesaid complaint case expeditiously within a stipulated period. 4. I have considered the submissions and perused the entire record. 5. In these circumstances and considering the fact that it is a very old case, the learned trial court is directed to decide the aforesaid case as expeditiously as possible, preferably within a period of one year from the date of production of certified copy of this order provided the parties cooperate with the proceedings of the trial and do not take any unnecessary adjournment. 6. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 7. With the above observations, the application stands disposed of. Order Date :- 7.4.2025 ss Digitally signed by :- SANDEEP SHARMA High Court of Judicature at Allahabad
