E SAMBASIVA PRATAP The Court made the following Order: The learned counsel for the petitioner, appearing virtually online, submits that the present writ petition is filed challenging the inaction on the part of the respondents in not paying the gratuity amount, balance earned leave, engagement, R.P.S. arrears of 1997, D.A. arrears, wage dues and 30% wage deduction, even after the lapse of nine years from the date of superannuation, as on the date of filing the writ petition in the year 2012. A further direction to release the same with interest at the rate of 12% per annum is sought in the writ petition. 2 2. The respondents, in their counter-affidavit, submit that the petitioner attained the age of superannuation on 30.06.2003 and his eligible terminal benefits have been paid. The petitioner is also receiving a monetary pension. 4. Insofar as the 30% wage deduction due is concerned, the respondents in the counter-affidavit have submitted that the Government has rejected the same and that the union is unable to sustain financially on its own. The union is also receiving financial assistance from the Government. 5. Recording the contention of the respondents, no further orders are required in this writ petition, leaving it open for the petitioner to take steps, once the issue of the 30% wage deduction amounts is decided by the Government with respect to the release of the 30% wage deduction to the members of the union. 6. With these observations, the writ petition is closed. There shall be no order as to costs.
