In view of the fact that there is an effective alternate remedy available to the petitioner by filing an application before the Debts Recovery Tribunal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act of 2002 (SARFAESI Act), we are not inclined to interfere at this stage by invoking our extraordinary jurisdiction.
2. The petition is dismissed. The petitioner would be at liberty to approach the Debts Recovery Tribunal. No order as to costs.
