Petitioner has superannuated from MADA. Even after superannuation his retiral benefit was not paid. Even today, his entire retiral benefit has not been paid in lumpsum, rather he is being paid in installment i.e. Rs.50,000/- per month. The petitioner stayed in the quarter allotted by MADA, but now the petitioner has vacated the same by virtue of the order of this Court. 3. Since, the entire amount of retiral benefit has not been paid in lumpsum, the respondents- MADA cannot deduct penal rent from the petitioner. They are directed to deduct normal rent and refund the excess amount which has been deducted to the petitioner. 4. With the aforesaid directions, the instant writ petition stands disposed of. 5. The respondents will calculate the normal rent and will refund the excess which has been collected from the petitioner, within two months from the date of receipt of a copy of this order. .
