2. The Court made the following:
1. This writ petition is filed under Article 226 of the Constitution of India to declare the action of respondents in opening and continuing of Extremist Suspect Sheet in C.No.351/E7/SIB(int)/2016 dated 10.6.2006, P.F.No.9/NLR against the petitioner as illegal, arbitration and violation of Articles 14, 19 & 21 of the Constitution of India and consequently direct Respondent Nos.4 & 5 to remove the suspect sheet from the records. 2. The case of the petitioner is that, the respondents opened Extremist Suspect Sheet in C.No.351/E7/SIB(int)/2016 dated 10.6.2006, P.F.No.9/NLR against the petitioner. Even though, approximately two decades have elapsed, without there being any reason and without following due procedure as contemplated , the same has been continuing against the petitioner. Hence the writ petition. 3. During hearing,
learned counsel for the petitioner submits that, the petitioner is aged 71 years now and neither any incident nor crime was registered against the petitioner. Even in the absence of any crime or incident, continuation of suspect sheet is contrary to the principles laid down by this Hon’ble Court. He further submits that, even though the petitioner time and again requested the respondents for closure of the suspect sheet, the respondents are not adhering to the request of the petitioner and requested to grant the relief as prayed for.
4. On the other hand, learned Government Pleader for Home furnished written instructions submitted by the Superintendent of Police, SPSR Nellore District vide C.No.753/C1/2025 dated 07.01.2025, wherein it is stated as follows:
“It is submitted that earlier, the petitioner participated in extremist acts and as such the extremist suspect sheet P.F.No.9/NLR was opened against him. From time to time, his movements are being watched. It is submitted that in such type of extremist suspect sheets, the police never call the suspects to the police stations, except watching his activities. Till 2023, the petitioner having links with the extremists which are confidential which cannot be revealed. Later, there were no movements of the petitioner with the extremists or links. Now the petitioner is about 71 years old and now he is not moving or participating or links with the extremists. After careful
consideration and in view of his age factors, the extremist suspect sheet vide PF No.9/NLR was closed against the petitioner on 26.12.2024.
5. Heard learned counsel for the petitioner, learned Government Pleader for Home and perused the material placed on record before this Court.
6. It appears that the since petitioner participated in extremist acts in the past, extremist suspect sheet was opened against him. After 2023, there were no movements of the petitioner with the extremists or links. Since the petitioner is now aged about 71 years, and as he is not moving or participating with the extremists, considering his age factors, Extremist Suspect Sheet vide PF N0.9/NLR was closed against the petitioner on 26.12.2024.
