The petitioner is apprehending his arrest in connection with N.D.P.S. Case No.85/2024 arising out of Chatra (Sadar) P.S. Case No.209/2023, registered for the offence under Sections 18, 22, 27, 29 of N.D.P.S. Act, pending in the Court of the learned Additional Sessions Judge-II-cum-Special Judge, N.D.P.S. Act, Chatra. 3. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. He further submits that the name of the petitioner has come on the confessional statement. He then submits that 850 gm each opium was recovered from the co-accused. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 17 of this application. He also submits that the co-accused persons have stated that on the direction of one Akash Kumar, the said opium was carried. He further submits that the quantity of the opium is intermediary. He next submits that co-accused persons have been provided regular bail by a Coordinate Bench of this Court. 4. Learned counsel appearing for the State opposed the prayer and submits that it has come in the case diary that the petitioner has suggested to involve in that business. Considering that the petitioner has got no criminal antecedent and he is not named in the FIR and even apprehended accused persons have taken the name of Akash Kumar and not of this petitioner and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, N.D.P.S. Act, Chatra in connection with N.D.P.S. Case No. 85/2024 arising out of Chatra (Sadar) P.S. Case No.209/2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 26th September, 2025 Ajay/
