2025:UHC:1906-DB SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS SPA No. 198 of 2015 Hon’ble Manoj Kumar Tiwari, J. Hon’ble Ashish Naithani, J. Mr. Amar Murti Shukla, learned counsel for appellant. 2. Mr. K.N. Joshi, learned Deputy Advocate General for the State. 3. Mr. Ishwari Datt Paliwal, learned Addl. C.S.C. for the State of U.P. 4. This intra-court Appeal is directed against judgment and order dated 09.01.2025, passed by learned Single Judge in Writ Petition (S/S) No. 1554 of 2012. 5. By the said judgment, Writ Petition filed by the appellant claiming appointment on the post of Junior Clerk, was rejected. 6. Learned Single Judge has considered the fact that appellant had served as ad hoc employee in the Office of Regional Transport Office only for a period of about one month and thereafter, his services were not extended any further. There is no law which permits regularisation of an employee who served on adhoc or daily 2025:UHC:1906-DB basis only for a period of one month. 7. Learned counsel for the appellant submits that in the Writ Petition, there was a specific averment made in paragraph no. 6 that two similarly situated persons, who were appointed in 1991 for one year, were given regular appointment subsequently. The circumstance in which those two employees were given regular appointment is not before this Court. 8. Every case has to stand on its own legs. Appellant does not have vested right to claim regularisation after serving for one month. Thus, learned Single Judge was justified in rejecting the claim staked by the petitioner. Thus, there is no scope for interference. Accordingly, the Special Appeal is dismissed. (Ashish Naithani, J.) (Manoj Kumar Tiwari, J.) 19.03.2025 Shiksha
