“Learned Deputy Advocate General submits that reply stands filed. Reply has not been placed on record. The office reports that reply is stated to have been filed in the Scrutiny Section, however, it is not traceable in the CWP Section. Let office to trace and place the reply on record.
2. At this stage, learned counsel for the petitioner made available a photocopy of the reply for perusal. As per the reply, petitioner though has completed much more than her normal tenure at GMS Kalaghat, U/C Narag, District Sirmour, H.P., yet, she has not been transferred from the said place owing to 22 students studying in the aforesaid school.
3. If above is the situation, it is for the respondents to transfer/deploy some other 1 Whether reporters of print and electronic media may be allowed to see the order? Yes.
2 incumbent to ensure that students’ interest is safeguarded. However, for that reason, petitioner cannot be directed to continue to serve at one station, more so, when she has also pressed into service the ground of her’s being a couple case as her husband is statedly posted in the office of Commandant, 5th IRBn Bassi, Tehsil Shree Naina Devi, District Bilaspur, H.P.
4. Let the respondent place on record fresh instructions/consideration order on the next date of hearing. List on 14.11.2025.”
2. Pursuant to above order, learned Additional Advocate General has placed on record office instructions dated 13.11.2025 alongwith order dated 12.11.2025.
3. Learned counsel for the petitioner sought permission to withdraw the writ petition submitting that petitioner intends to make fresh representation to the respondents for her adjustment.
